Terms of Service

By creating an account on ModBay ("modbay.cc", the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Platform. We reserve the right to update these Terms at any time, and continued use of the Platform constitutes acceptance of any changes.

ModBay is a car showcase and community platform that allows users to create profiles for their vehicles, share modifications, performance data, and photos. Users can follow other users, like and save builds, and customize the visual appearance of their car pages and profiles. ModBay also offers premium subscription tiers with additional features.

To use ModBay, you must:

• Be at least 13 years of age
• Provide a valid email address
• Choose a unique username
• Create a secure password (if not using social sign-in)
• Agree to these Terms and our Privacy Policy

You may also sign in using Google OAuth. When doing so, your name, email, and profile picture from Google will be used to create your account. You are responsible for maintaining the security of your account and password. ModBay is not liable for any loss or damage arising from your failure to comply with this obligation.

"User Content" refers to all data, images, text, vehicle information, modifications, and any other material you submit to the Platform. You retain ownership of your User Content. By submitting User Content, you grant ModBay a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Platform.

You agree that your User Content will not:

• Infringe on any third-party intellectual property rights
• Contain illegal, harmful, threatening, or abusive material
• Include malicious code, spam, or unauthorized advertising
• Violate any applicable law or regulation

ModBay reserves the right to remove any User Content that violates these Terms or that we deem inappropriate, without prior notice.

ModBay stores vehicle information including make, model, year, performance specifications, modifications, and custom traits that you provide. This data is used to power your car profiles and may be used in aggregate (anonymized) form to develop new features such as parts compatibility tools, modification recommendations, or community statistics. Images you upload (vehicle photos, hero images, profile pictures) are stored on Cloudflare R2 cloud storage. By uploading images, you confirm that you own the rights to those images or have permission to use them. Images associated with public builds are accessible to anyone via direct URL. Images are deleted from storage when you remove them from your build or delete your account.

ModBay offers free and paid subscription tiers. Paid subscriptions are processed through Stripe. ModBay does not store your credit card or payment method details directly — all payment information is managed securely by Stripe in accordance with PCI compliance standards.

Subscriptions renew automatically unless canceled before the end of the current billing period. You may cancel your subscription at any time from your account settings. Upon cancellation, you retain access to premium features until the end of your paid period.

ModBay includes social features such as following other users, liking builds, saving builds, and receiving notifications. You can control your privacy through settings including follow approval, visibility of follower/following counts, and profile visibility (public, followers-only, or private).

Individual car builds can also be set to public, unlisted (accessible only via direct link), or private (visible only to the owner). You may also control whether others can save/bookmark your builds.

You agree not to:

• Use the Platform for any unlawful purpose
• Impersonate any person or entity
• Scrape, crawl, or harvest data from the Platform without permission
• Interfere with or disrupt the Platform's infrastructure
• Attempt to gain unauthorized access to other user accounts
• Upload viruses, malware, or malicious content
• Harass, bully, or threaten other users
• Use automated tools to create accounts or interact with the Platform

You may delete your account at any time from your dashboard settings. Upon deletion, all your profile data, car builds, modifications, images, likes, follows, and notifications will be permanently removed. This action cannot be undone.

ModBay reserves the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or are inactive for an extended period, with or without notice.

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. ModBay does not guarantee that the service will be uninterrupted, error-free, or secure. Use of the Platform is at your own risk.

To the maximum extent permitted by law, ModBay and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform, including but not limited to loss of data, loss of profits, or damage to vehicle or property.

The ModBay name, logo, visual design, and all original content created by ModBay are the intellectual property of ModBay. You may not use, reproduce, or distribute any ModBay branding without written permission. All third-party trademarks, vehicle brand names, and logos displayed on the Platform belong to their respective owners.
